New York HERO Act: What You Need to Know

On September 6th, Governor Kathy Hochul announced the designation of COVID-19 as an airborne infectious disease under the New York HERO Act. This designation requires all employers to implement workplace safety plans compliant with the NYS Department of Labor now.

According to the DOL, each employer is required to:

  • establish a written exposure prevention plan designed to eliminate or minimize employee exposure to airborne infection agents — such as COVID-19
  • provide a copy of the adopted airborne infectious disease exposure prevention plan and post the plan in a visible and prominent location within each worksite
  • select and incorporate appropriate exposure controls based on the types and level of exposure risks employees have during all activities performed at the worksite
  • the following controls shall be included in the plan: Health Screening, Face Coverings, Physical Distancing, Hand Hygiene Facilities, Cleaning and Disinfection
